The Myths & Realities About Web Site Ownership

March 9th, 2009

The internet, the World Wide Web itself, doesn’t claim any ownership to the trillions of sites nesting in it’s universe like cyberspace. The conflict or should I say, confusion over who does own the rights to a web site is simply understanding the myths versus realities of published works on the net.

Myth: If you paid for the creation of a web site, you own the design not the web designer.

Reality: The web designer owns the copyright unless they otherwise agree to sell the copyright to the client. Of course, this only pertains to independent web designers. It is not the case if an employee builds and maintains their employer’s web site, the company and or employer owns the rights.

Reality: You only own the content that belonged to you that you provided to the web designer for the site. All other content is owned by the web designer who created the works, and by all third parties that provided additional elements who own the rights, but by agreement, are part of the design of the site.

Myth: You should purchase the domain name for registration in your name and not the web company for registration in their name, so not to hold your domain hostage.

Reality: Any and all reputable web designers provide ‘ Client Option’ for domain name registration. Who owns the domain name is only important if the rights to the site, by agreement, will be sold to the client.

Myth: If you paid for the creation of a web site, you yourself have the sole right to publish it on the internet.

Reality: The web designer is the only one who has the sole right to publish the site to the internet. If you purchased, by agreement, the copyright, then and only then do you have the sole right to publish it on the internet.

Myth: You should have the hosting company in your name with Login/User ID, password information in case the web company decides to take the site down.

Reality: Any and all reputable web designers provide all hosting information, which usually is stated in the contract agreement. If you own the rights to the site, you most certainly have the right to host the site with what ever hosting company you choose. As for a reputable web company suddenly and without provocation taking the site down. It just doesn’t happen.

Myth: The web designer must provide you with FTP Access Code, Username, Login ID/Password in case something happens to the web company or you want to switch companies.

Reality: Again, any and all reputable web designers will provide you this information. But if you don’t own the rights, you or another web designer you hire, are not allowed to access the site. If you decide you want to go with another company, unless you purchased the rights, the new company you hire will be designing you a whole new site.

Myth: You should keep in your possession a copy of the web site.

Reality: The nature of a web site is to be in a constant flux, taking advantage of the web’s fluid and flexible nature. Content on most sites change on a regular bases. What was first used to design the site will have changed over and over again. A reliable web designer that’s maintaining the site will keep a backup of the site as the site is updated. What you most likely will utilize is a copy of the site on a CD for promotional purposes, but you will need a new CD made as the site itself changes.

Also, for anyone to pay a few thousand dollars for the copyright to a web site that continually must change in order to be of use, makes no sense. If complete ownership is important to you for what ever reasons you have, then it would make more sense to pay to take a course in IT and web design and therefore design and maintain your own site.

Companies and individuals who hire a web designer, do so, because they don’t have the skills to design and maintain the site themselves. Even though there are plenty of non-skilled individuals building sites of their own using web design tools provided on the web, these self-built sites are strictly amateurish.

Thus the all important reality is . . . a well designed, successful web site is literally a partnership between the reliable, skilled person who created and maintains it and the non-skilled person who wants the advantage of an internet presence, making good use of it.

WHEN SAFE IS NOT THE BEST

March 6th, 2009

“Why not go out on a limb? That’s where the fruit is.”

(Mark Twain)

Safe is a word that many people use every single day. Safe is also a place where everyone wants to be. We are then secure and nothing will hurt us. The truth is that while nothing will hurt us, we are hurting ourselves.

Going out on a limb as Mark Twain so aptly put it can be stressful. There may be dangers lurking in the corners and we might stumble and fall. Yes, these possibilities do exist. It does not mean that they are inevitable and guaranteed to happen.

If we stand still, we give way to turning into stone. Apathy takes over our lives and we find ourselves in a self-imposed prison with bars of failure. Not trying constitutes never knowing if you could. If you are a writer and you don’t put your ideas down on paper, you will never experience the thrill of having people take your words and make them a part of their lives. If you are a mechanic, not going out on a limb will never give you the feeling of accomplishment in knowing that you solved the problem, you found the source, and you helped someone. All jobs and careers involve the possibility of advancement, increased knowledge, and the ability to reach out and make a difference in the lives of other people.

The fruit at the end of that limb may be a new friendship, the learning of a new skill or technique, and even the wonderful warm feeling of having done a good day’s work for a day’s pay. When you serve that order in a fast-food restaurant, even if your efforts are not readily appreciated, you know that this person was treated in a very pleasant and helpful way. You did what you could do, and hopefully, they will go on to do something nice to someone else. You started the chain reaction or you kept it going. Either way you did not stand still, you did not stagnate, and you made a difference.

Your words, your actions, and your attitude will be evident to everyone around you. There is always the possibility that someone you think is out of hearing distance or is just not paying any attention does take note of you. Don’t risk the chance that they just may need to hear a person that takes life and makes the most of it. This hope of knowing that one person out there is not going to let the world get them down may just be the push they need to keep on trying, and not quitting.

As an author, when you tell your story or relate your feelings, or even report on an event, it’s the way you present what you are writing and in essence, it is sharing yourself with others.

Whether you do write, or paint, or work in a factory, you are what the world will see today. Go out on the limb. Don’t let a single day go by that you don’t give your world all the strength you can muster, and the ability to know that you are reaching for that fruit at the end of your limb. Maybe, and you may never really know, you helped someone start climbing their own tree and even reach that prize that at first seemed so far out of reach.
Believe in yourself, reach out for new heights, and give only the best example of what a person can do with the life they are given. You will reach people, you will touch hearts, and you may just be the one person that makes a difference to another between closing that prison door of self-imposed failure or opening a window and breathing in the fresh air.

Whatever you do in life is never self-contained. Every action is like a pebble that is thrown in the water. The ripples grow larger and larger. Your actions or attempts at living the best life you can will have that same effect in the world. If you don’t throw in your stone, then that ripple may not reach the one person where only you can make a difference. Don’t let this tragedy happen. Give of yourself to whatever you undertake so that others may grow. Your own harvest will just be that much sweeter.

Good Grief, I Learned a Lot, Charlie Brown!

March 6th, 2009

For 50 years the daily comic strip ‘Peanuts’ entertained millions of readers. Every day, the adventures of Charlie Brown, Snoopy, Linus and the whole gang provided many laugh-out-loud moments while at the same time offering a daily inspiration and lessons on life.

With the recent death of ‘Peanuts’ creator Charles Schulz, I reflect on how much I enjoyed sharing the adventures of the ‘Peanuts’ gang and I remember the many lessons they taught me…

1. It’s okay to be afraid… just don’t let your fears control you. Charlie Brown often sat in bed and spoke of his fears, but no matter how scared he was, he always did the things he wanted to do.

2. Persistence wins out. Charlie Brown often lost, failed at much, but he never gave up. Even though he knew Lucy was going to pull the football away before he could kick it…. Even though he knew the tree was going to eat his kite… Even though he knew his team would lose the ball game, he kept on trying.

3. It’s what you think of yourself that counts. Linus carried a security blanket for years and his friends laughed at him. They also laughed at him because he believed in the “Great Pumpkin.” Pigpen was a walking cloud of dust and dirt and was often regarded unkindly. Both characters, however, were always proud of themselves and believed they were as good as anybody else — and they were right.

4. Sometimes you need to talk. One thing the ‘Peanuts’ gang understood was the importance of talking things out. Whether leaning up against Schroeder’s piano or atop the brick wall, they always had someplace to discuss what was of concern to them.

5. Sometimes you need to listen. Even crabby, self-indulged Lucy knew the importance of listening. She started the famous ‘Psychiatry Booth’ where any and all could come and be heard.

6. Do what you love to do. Through all their adventures, Schroeder remained constant in his appreciation of Beethoven and his love of playing the piano. He loved to play piano and that’s what he did, regardless of the circumstances. Charlie Brown flew his kite, played baseball and football, not just to win (he knew he wouldn’t), but because he loved to do those things.

7. It’s important to have friends that care. The ‘Peanuts’ gang was made up of individual characters, each with their own foibles and talents, but through it all they were always there for each other.

8. Big dreams lead to big things. Snoopy was the biggest dreamer of them all, but his wild imagination often led to even wilder, more fantastic adventures in real life. Snoopy knew that you must have a big dream if you are going to lead a big life.

9. Action creates reality. As Charlie Brown was reminded time and again after prodding from Linus: it takes action to bring about change. Though he often failed, Chuck took action quite regularly… and every now and again things would go his way.

10. Laugh every day! While the kids themselves may not have seen the humor in the things they did, Schulz made sure that we did. Life is only as serious or as humorous as YOU make it.

Lighten up. Go play softball. Fly a kite. Dance with your dog. Smile… it makes people wonder what you’re up to.

CA Auto Insurance Laws and Requirements

March 5th, 2009

Legal Requirements

  • Bodily Injury Liability: $15,000/$30,000 Limit
  • Property Damage Liability: $5,000 Limit

*Required limits for drivers in the CA Automobile Assigned Risk Plan are $10,000/$20,000/$3,000 Limits

The state of CA follows a Tort system. This implies a person must be found to be blameable for causing the accident, and that individual and their insurance underwriter is liable for all the resulting damages. Be mindful that the details of a tort system vary from state to state.

You can get uninsured driver coverage added to your california auto insurance in order to compensate bodily injury caused by an uninsured and/or underinsured motorist (depending on the state). In CA, you’re not required by law to have this coverage, but it could become valuable if you are in an accident with an uninsured motorist

In 2003, the average premium for auto insurance within CA was $950. The national average was $914. There are people who believe that their rates are determined by the state and therefore do not seek to find lower rates. However, they are incorrect. If you do decide to compare current auto insurance rates for the lowest rates, you may end up being pleasantly surprised that you can save hundreds or even thousands of dollars per month. There are many insurance sites online that allow you to view rates from multiple auto insurance companies to help you find the cheapest insurance rates available.

It took almost 10 years (1999-2007) to see the most recent decrease in insurance premiums. That year saw a .5% to 1% reduction in average insurance premiums from the previous year. Nevertheless, 2009 has already seen increases in average insurance costs and it will most likely continue for the rest of the year. To find better quotes, it’s best to shop online and compare various rates.

Premiums change over time and especially in a state like California, you may wind up paying more for your insurance coverage. Looking back, the average auto insurance rate in 2000 was about $767; it increased 24% in just 3 years! Since then premiums have fluctuated.

How to Change Your Web Hosting Provider Without Any Downtime

March 4th, 2009

The idea of moving your website from one host to another can sometimes feel like a daunting task. However the process is a simple one when you know how. This article is going to walk you through eight simple steps to make sure your site is moved easily without experiencing any downtime.

The most important thing to remember is DO NOT CANCEL YOUR EXISTING ACCOUNT until the very last step. Even if you are very unhappy with your existing provider it is essential that the account remain active until you are 100% sure that you entire account is up and running smoothly or it could end up causing you a great deal of unnecessary problems in the long run.

Eight simple steps on how to change your web host without any downtime to your website.

Step 1. Create a new account:

Once you have chosen your new web host simply sign up for your chosen package and create a new account (you will now have two accounts one with your current host and one with the new host).

Step 2. Download your files from your old account:

Next simply go back to your old web host provider and download all your files, (this can be done simply by connecting to the web hosts ftp). Remember that even after you have downloaded these files you must still keep this account active.

Step 3. Upload the files to your new account:

As soon as your files have been downloaded go to your new web host and upload your files (via the new hosts ftp).

Step 4. Create email accounts:

To avoid losing any emails when you later change your name servers, it is essential that you now create all the same email accounts you had at your old hosting account, in your new hosting account. Once this is done you should now have identical information in both your new and old accounts.

Step 5. Check you files and links:

To make sure that all of the files have been updated correctly and that all the links within your website are functional, all you need to do is view your website using the temporary URL addresses provided by your new host.

Step 6. Change your DNS:

If all your website is showing correct, only at this point should you change your domain name servers (DNS). Your new host should have provided you with their DNS. If they have not contact them and ask what DNS you should use for your domain name (will be something like ns1.new hostname.com and ns2.newhostdomain.com).

Who you contact to change your DNS depends on who you registered your domains with. If your domain was registered through a domain registrar contact them or of you registered the domain at your old web host contact them. When you call simply ask them to change your domain names servers (DNS) to the new DNS given by your new web host.

Step 7. Wait for DNS to propagate:

Once the changes have been made to your domain name servers (DNS) it will take 24-48 hours for your domain to propagate. During this time your website will be viewed from the old web host, only once the propagation is completed your site will be viewed from your new web host.

Step 8. Cancel old Account:

Make sure you wait at least 48 hours until your domain has resolved to your new hosting provider before canceling your account with your old web host.

Conclusion

By following these simple steps you should have now successfully moved your website from your old host to your new host without any downtime.

Trampoline Safety

March 2nd, 2009

Trampolines are one of the most popular outdoor activities (alongside more traditional paddling and swimming pools)for adults and children alike, infact in recent years the UK has experienced a huge boom in the popularity of garden trampolines. Alongside the huge rise in trampoline sales is also the unforunate rise of trampoline related injuries and incidents at A&E across the country, its is therefore important that your trampoline is always used safely.

Its worth following these guidelines to ensure your trampoline is used as safely as possible:

1. Ensure that your trampoline is positions on a flat soft surface (grass is ideal). It is not advisable to position a trampoline on a patio, tarmac or gravel surface.

2. Safety Zone – Most trampoline manufacturers advise leaving a safe zone (ie an area that is left clear of obstructions and items) of around 2.5 meters.

3. Young children should always been supervised when using a trampoline.

4. Most trampolines are only recommended for use by one person at a time.

5. Safety Nets are available for nearly every trampoline and there use is highly recommended.

6. Pets and Children should not be allowed underneath the trampoline when the trampoline is in use. Some manufacturers offer a trampoline skirt, which will close off this area securely.

7. Regular maintenance inspections of your garden trampoline are highly recommended. You should regularly check the following:
o The joints on the frame for signs of cracking and weaknesses
o The fabric for any signs of wear or fraying
o The springs for any signs of wear or damage

If any faults are discovered, you should consult a qualified person of the manufacturer.
